Holifield & Associates, P.C. (HAPC) is a law firm that primarily practices in the areas of employee benefits, employee benefits litigation, employment, corporate, estate planning and elder law. Litigation
HAPC represents clients regarding all employee benefit litigation matters, including fiduciary claims, subrogation claims, denial of benefit claims and ERISA § 510 claims as well as retiree health, executive
compensation and severance claims. We also represent clients before the Department of Labor and Internal Revenue Service regarding audits or litigation concerning employee benefit plans. HAPC has
experience in all facets of employment litigation, including Title VII claims, sexual harassment and wrongful termination claims. Our goal is to professionally and zealously represent our clients in all facets of
our practice. HAPC has successfully represented clients before the United States Supreme Court (Yates v. Hendon, 541 U.S. 1 (2004)), the Fourth and Sixth Circuit Courts of Appeal, and the U.S. District
Courts for the Eastern and Middle Districts of Tennessee, as well as the Western District of Virginia. We have represented clients at every court level within the State of Tennessee and handled litigation
matters in Florida, South Carolina and Kentucky. HAPC fully utilizes all methods of resolving cases including all alternative dispute resolution methods.
Transactional
HAPC represents a variety of individuals and public, private and closely-held businesses concerning retirement plans, health plans, self-insured and insured benefits, nonqualified deferred compensation plans,
cafeteria plans, severance plans, COBRA, HIPAA, employment law, estate planning and corporate matters. We assist clients with drafting and administration of retirement and welfare benefit plans and also
assist with plan reporting, disclosure, notice requirements, compliance audits, DOL investigations, employee agreements, employee handbooks, EEOC and state human rights investigations, wills and trusts,
entity organization for corporations, LLCs, partnerships and non-profit companies and mergers and acquisitions.
